You will have one extra class period for each reading assignment this upcoming week. I wrote it out in detail below.

For class on Tuesday, Jan 16. Please read (or review) the assignment from Thursday, Jan 12. This assignment is listed as follows.

Pre-class reading assignment: Plater, Environmental Law and Policy: Nature, Law, & Society (afterwards referred to as “Text”) Read Chapter 10, pages 419-432. Please pay careful attention to Tennessee Valley Authority v. Hiram Hill, pages 425-428.

(Please note these page numbers are from Edition 5. You will need to read Chapter 10: Roadblock Statutory Strategies and the Endangered Species Act. Introduction (skip the Delaney Clause), A Fish, A Dam and ESA Section 7, and the lightly review the comments and questions. (Do not read another case after the TVA v. Hill Case).

For class on Thursday, Jan 18, please read the following material originally scheduled for Jan 16:

Reading Assignment: Chapter 6, pages. 199-212. Chapter 6: The Administrative Law of Environmental Law and Agency Process, Evolution of Administrative Law, the Administrative Law in a nutshell, the Source of Administrative Power (okay to skim). Please read carefully Section 3 "The Snail Darter Case: An Agency is Brought to Court for Violating Federal Law"

Please pay careful attention to Hiram Hill v. Tennessee Valley Authority on pages 208 to 209. (Note this is a different case with a different outcome than TVA v. Hill.
